Terms and Conditions
I don't have access to a lawyer so I'll keep this in plain English. Everything written here is either written elsewhere on the site or common sense, but I decided to have a T&C page just in case.
DEFINITIONS
Obviously, "owl" in all cases refers to an owl illustration as opposed to an actual owl.
ORDERING AN OWL
Writing your full name is preferable but not really necessary. It's mostly for contact purposes. In any case, it won't be shown to the public - only the public name is.
The description is just to give me an idea of what you'd like on the picture and I can interpret it any way I like. For instance, if you ask for an "owl logo" I can just as well draw an owl drawing a logo instead of a logo that features an owl. You get the drift.
Ordering an owl is not a guarantee of actually getting one. For instance, if your description is obscene, racist, offensive, or disagreeable in any way, I'll just refuse to do it. (Suggestive is ok though.) Or, if I'm unable to do your owl for some reason (for example, have to shut down the site, database gets deleted, I break my hand etc) I won't.
There isn't a set waiting period. I'll try and put a message on the site if I expect considerable delays or can't take in any orders right now, but this isn't guaranteed.
PAYMENT AND RECEIVING THE OWLS
The price of an owl is £5 (five pounds sterling). You will only receive the invoice when your owl is ready. Payment IS a guarantee of getting an owl. You will get your owl within 2 working days of paying for it. However, you can't ask for a refund after you've received it.
I'll send the owl in a high-quality, high-resolution 24-bit PNG unless the medium in which the owl is done requires something else. If I make an animation loop, for example, it could be a SWF or a GIF. Different formats or sizes provided as a courtesy if you ask nicely.
If I don't receive payment for an owl in 2 weeks, I will consider it unclaimed, which means I own the copyright and am able to use if for merchandise and so on if I feel like it.
If your owl is done on a non-digital medium, I may choose to offer you the original drawing/sketch/object after payment of the £5. The original will obviously cost extra (price will be determined depending on the object) and shipping costs will be included in the price.
ILLUSTRATION CONTENT
The illustration WILL contain an owl (or the shape of an owl), but in any degree of abstracion, stylisation, in any level of detail, any medium, with or without a background or additional objects, black and white or colour. Again, the description you provide only serves to give me a direction for the illustration, and I'm not responsible if you think I haven't followed it properly.
OWNERSHIP
Unless you tick the copyright checkbox when you order, you will still own the owl, but it will be released under a Creative Commons Attribution Non-commercial Share Alike licence, which means anyone (myself and yourself included) can download and reuse the owl for their own purposes as long as they credit the creator (me) and the person who ordered it (you) and do not profit from it.
If you tick the box, you own the illustration and are free to use it, resell it, and so on as much as you like. However, I reserve my right to put the illustration in the gallery (without making it available to download) and to also use it to advertise the Owl for a Fiver website. That includes website screenshots, posts on the web, and (I do hope!) articles and exhibitions. "Advertising the website" entails me or somebody else posting the owl illustration alongside a link and/or the Owl for a Fiver logo. You will be credited as the copyright owner in each of these instances.
You can't opt-in to copyrighting your owl after you've received it.
Regardless of whether you've chosen the copyright option or not, I will NOT try and make more money from the owl except when I make YOU an offer to purchase the original (if applicable) or if I ever include a print option.
In case of unclaimed / unpaid for owls, I remain the copyright owner, which means I can do whatever I please with them (including making promotional merchandise and reselling them).
DISCLAIMER
I am not responsible for any harm or damage that comes out of using the owls, or anything you do with them after I've received payment for them. I reserve the right to change these terms and conditions without warning if I want to.
PRIVACY POLICY
I'll keep the information you provide only to keep track of who ordered what, and will contact you only regarding the owl that you've ordered. After you've recieved your owl, I might contact you regarding the copyright of your owl, or if you've checked the "I would like a print" box and prints have been made available. I will NOT pass any information that I've collected to any third parties.
